Actually, if this is an adjustment hearing with USCIS, it would really depend on the interviewing officer and the specific facts. However, if the person was denied adjustment in the US, they'd still be able to apply for the immigrant visa back home. If this is an immigrant visa interview at the embassy overseas, it's less likely to be a problem, but it's still possible. If there was a finding that this was somehow misreprsentation or fraud with the original visa used to stay in the US, that would lead to a denial, but even then, the person could file a waiver application based on the marriage with a US citizen.Can a marriage visa be denied because of working without EAD?
Depends on the IO interviewing you. If he is a hard ***, then you're in trouble.
If you are an F1 student and have an EAD for 20 hours work time and say you work a full time job, but pay your taxes, then it is forgiven.
But working without an EAD completely is illegal....If you pay taxes though you may be able to show some moral character....
Working without an EAD can get you deported. It is up to the immigration officer. Working too soon is illegal and shows you are a person of low moral character that only obeys laws when it is convenient for them. Not a good thing to show when asking to move here.
Yes, working without it can lead to deportation. This is not something that is just 'forgiven.'
