If you do indeed get married, you would have to file as ';Married-Filing Jointly'; or ';Married-Filing Separately';. Either way, his name and social security number are reported on your return.

Personally, I'd want to see his W-2s and figure out if he's just been lazy--withholding enough money to pay tax, but then simply not filing to get a refund (a waste of money, but not illegal) or whether he's a scoflaw who flagrantly thumbs his nose at the law (steer clear).

Tell him to get his tax liability in order before getting married. The IRS can come after you too unless you file MFS. If you file MFS, you will have to disclose your BF's SSN.
If you file as Single or HOH, you are filing a false tax return which will get you into trouble.
No it is filed in your local county. Have him do his taxes BEFORE you marry him so you are not held liable for any of them. If he gets caught you can file injured spouse and retain some refund.
